Since I had to look for it on my own...here is Florida's description of the laws pertaining to registration and issuance of license.

Section 320.01(28), Florida Statutes, states, \"MOPED\" means any vehicle with pedals to permit propulsion by human power, having a seat or saddle for the use of the rider and designed to travel on not more than three wheels, with motor rated not in excess of 2 brake horsepower and not capable of propelling the vehicle at a speed greater than 30 miles per hour on level ground, and with a power-drive system that functions directly or automatically without clutching or shifting gears by the operator after the drive system is engaged. If an internal combustion engine is used, the displacement may not exceed 50 cubic centimeters.

The definition of motorized bicycle only includes electric motors of no more than 200 watts and max of 20 mph on flat ground.

Section II. General Information:

B. Dirt bikes noted for off road use, motorized bicycles and Go-Peds are not registered.

My interpretation(mine solely, you should still clarify with your local DMV)of this is:
A motorized (gas)bicycle of less than 50cc does need to be registered as a moped and as a motorcycle if over 50cc.<br><br>Post edited by: travis, at: 2007/09/03 23:39

Thanks for posting that. You CAN go over thirty mph, but you most likely won't often.

Florida DMV's opinion on registering these bicycles!!!

Released in March 2010...

Scenario:
A company is advertising on TV a gas engine kit that can be
added to a bicycle.
The engine is tied into the pedal system like
a Moped and it has to be pedaled to start the engine. It is
advertised that the bicycle will be propelled to 30MPH.


Question.

How is the tax collector supposed to register this bicycle/gas
engine assembly?

Answer
The definition of bicycle under s. 316.003(2), F.S., includes
motorized bicycles.
Bicycles are not registered or titled.
Engine kits for bicycles are not new and there are a variety of
kits available, however, they remain bicycles after the engine
kit is installed.
There are other
requirements that must be met
to be classified as a
motorcycle/scooter/moped such as frame
assembly and safety
features.
If a customer brings in paperwork for
a bicycle, they cannot be legally issued a title or
registration nor is it required.
The agent should also direct the
customer to law enforcement if there are any questions as to
where the motorized bicycle can be used.





I am currently forcing the Brevard County Court System to seat a jury for the tickets I was given....

I anticipate a win.

These are bicycles, regardless of having a motor hanging off of it...It says so.

I was charged with driving with a suspended license with knowledge and no motor vehicle registration....

They have since offered to drop it to "operating motor vehicle on a sidewalk"...This implies they are doubtful of a conviction on initial charges based on current Florida law.....I will update as to whether I win or lose...Even the public defender started out saying that I couldn't win, not 6 months later she is confident of all charges being eventually dropped...
Ride your bike ans argue the charges...Florida's Laws concerning these bikes is in a such a gray area they are starting to lose their cases against us riders...We need to challenge them at every turn to either leave us alone or to make a law specifically dealing with these bike motor kits...By the way..Florida DMV has a memo out to their employees that these bikes are no more a motor vehicle than any other bicycle is, whether it has a motor kit on it or not...THEY WILL NOT REGISTER THEM IN ANY CASE !!!

Charges dropped ..Official word is...NOLLE PROSEQUI !!!!!!

Florida laws are so jumbled concerning these bikes...Force them to a jury trial and stick with it...THEY WILL DROP THE CHARGES, EVENTUALLY !!!!!
